Terms of Service

These Terms of Service ("Terms") govern your use of Arkidor, a browser-based ArchiMate® modelling tool operated by Knaap ("we", "us", "the Service").

By accessing or using Arkidor, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Arkidor is a free, browser-based tool for creating and editing ArchiMate architecture models. The Service operates entirely client-side: your models are processed and stored in your browser. We do not receive, store, or have access to your model data.

2. Eligibility

You may use Arkidor if you are at least 16 years of age. If you use Arkidor on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Your Content

You retain full ownership of all models and data you create with Arkidor. We claim no rights over your content. Since your data never leaves your browser, we have no ability to access, modify, or disclose it.

4. Acceptable Use

You agree not to:

• Attempt to disrupt or overload the Service infrastructure
• Use automated scripts to scrape or burden the Service
• Reverse-engineer, decompile, or extract the source code of Arkidor
• Remove or alter copyright or trademark notices
• Use the Service for any unlawful purpose

5. Intellectual Property

Arkidor and its source code, design, and documentation are the proprietary property of Knaap and are protected by copyright and other intellectual property laws. All rights reserved.

Third-party open-source components used in Arkidor are listed in the THIRD_PARTY_LICENSES.txt file distributed with the application and are governed by their respective licences.

ArchiMate® is a registered trademark of The Open Group. Arkidor is not affiliated with, endorsed by, or certified by The Open Group unless explicitly stated.

6. Availability and Changes

We provide Arkidor on an "as available" basis. We may:

• Modify, suspend, or discontinue the Service (or any part) at any time
• Release updates that change functionality
• Introduce paid tiers or features in the future (existing free functionality will remain free)

We will make reasonable efforts to communicate material changes via the website or changelog.

7. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Defects will be corrected within any timeframe
• Models created with Arkidor will be compatible with any particular third-party tool
• The ArchiMate notation implementation is complete or free of errors

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KNAAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or wilful misconduct.

9. Data Loss

Since Arkidor stores data in your browser, you are solely responsible for backing up your work. Data may be lost if you clear browser data, switch browsers, or experience hardware failure. We strongly recommend saving your models to files regularly using the Save/Export functionality.

10. Indemnification

You agree to indemnify and hold Knaap harmless from any claims, damages, or expenses arising from your violation of these Terms or your use of the Service in a manner not authorised by these Terms.

11. Termination

We may restrict access to the Service if you violate these Terms. You may stop using the Service at any time. Your locally stored data remains yours regardless of termination.

12. Governing Law and Disputes

These Terms are governed by the laws of Finland, without regard to conflict of law provisions. Any disputes shall be resolved in the district court of Helsinki, Finland.

If you are a consumer within the EU, you retain the benefit of any mandatory consumer protection provisions of your country of residence, and you may bring proceedings in your local courts.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Knaap regarding Arkidor.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the website. Continued use after changes constitutes acceptance of the updated Terms.
